Welcome to Pawcket. These Terms of Use ("Terms") govern your access to and use of the Pawcket website, mobile experience, and related services (the "Service"), operated by Instinct Theory Inc. ("Pawcket," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Not Veterinary Advice

Pawcket is an informational tool. It is not a veterinarian, does not provide veterinary diagnosis or treatment, and is not a substitute for professional veterinary care.

  • Symptom triage, toxin reference, medication information, nutrition guidance, and all other content are for general informational purposes only.
  • Severity indicators (mild, moderate, serious) are estimates based on the information you provide and may be incomplete or wrong.
  • In an emergency, contact your veterinarian, an emergency animal hospital, or a poison control service immediately. Do not delay seeking care because of anything you read or receive through the Service.
  • Never disregard professional veterinary advice or delay seeking it because of information from Pawcket.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. By using the Service, you confirm that you have the legal capacity to enter into these Terms.

3. Your Account

  • You are responsible for the accuracy of the information you provide, including pet profile details.
  • You are responsible for keeping your login credentials secure and for all activity under your account.
  • Notify us promptly through our Contact Us page if you suspect unauthorized access.
  • You may browse parts of the Service without an account, but an account is required to create and save pet profiles.

4. AI-Generated Content

Parts of the Service use artificial intelligence, including chat responses, symptom triage, summaries of uploaded records, and suggested profile updates.

  • AI output may be inaccurate, incomplete, or out of date.
  • Auto-extracted information from uploaded documents (such as vaccination dates or medication names) may contain errors. You are responsible for reviewing and correcting your pet's profile.
  • Vet Summaries and similar outputs are generated from the information in the profile and should be verified with your veterinarian.

5. Your Content

"Your Content" means information and files you submit to the Service, including pet profiles, medical details, photos, documents, notes, and chat messages.

  • You retain ownership of Your Content.
  • You grant Pawcket a limited, non-exclusive, worldwide license to host, store, process, display, and transmit Your Content solely to operate, maintain, and improve the Service and to provide the features you use (for example, generating summaries, reminders, and shared views).
  • You represent that you have the right to submit Your Content and that it does not violate any law or third-party rights.
  • Do not upload content that contains personal information about other people unless you have the right to do so.

6. Sharing and Co-Ownership

Pawcket lets you share pet profiles with other people, such as family members, pet sitters, and veterinary professionals.

  • Shared access allows the recipient to view and/or chat about a profile, depending on your plan, without the ability to edit.
  • Co-ownership grants the recipient full edit rights to the profile.
  • You control who has access and may revoke access at any time. Share links, QR codes, and invitations should be shared only with people you trust.
  • You are responsible for the people you share with. Anyone with access may see the pet's information, including medical details and any information entered by others.
  • Recipients who receive access through a paid plan of the sharing account holder are not required to purchase a separate subscription for that access.
  • Only the profile owner may delete a pet profile.

7. Subscriptions and Payments

  • Some features require a paid plan. Plans, features, and prices are described on our Pricing page and may change from time to time.
  • Paid plans renew automatically at the end of each billing period until canceled.
  • You may cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then.
  • Except where required by law, fees are non-refundable.
  • We will give reasonable notice of price changes before they apply to your next renewal.
  • If you downgrade or your subscription ends, certain features (such as file uploads or chat on shared profiles) may become unavailable or limited.

8. Reminders and Notifications

The Service may send in-app and push notifications, including medication and vaccination reminders. Reminders are provided as a convenience and may fail or be delayed due to device settings, connectivity, or technical issues. You remain responsible for administering medications and keeping vaccinations up to date.

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, harmful, or fraudulent purpose.
  • Upload malicious code or attempt to disrupt, overload, or gain unauthorized access to the Service or other users' accounts.
  • Scrape, copy, or reverse engineer the Service except as permitted by law.
  • Submit false or misleading information, or impersonate another person or veterinary professional.
  • Use the Service to provide veterinary services to others or to represent that Pawcket output is professional veterinary advice.
  • Misuse the sharing features, including sharing profiles without the right to do so or harassing other users.
  • Abuse or attempt to manipulate the AI features, including attempting to bypass safeguards.

10. Intellectual Property

The Service, including its software, design, text, graphics, logos, and trademarks (including "Pawcket"), is owned by Pawcket or its licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use in accordance with these Terms. No other rights are granted.

If you send us feedback or suggestions, you grant us the right to use them without obligation to you.

11. Third-Party Services and Content

The Service may rely on or link to third-party services, including hosting providers, payment processors, analytics tools, and references to third-party resources such as poison control services. We do not control and are not responsible for third-party services, content, or policies. Any fees charged by third parties (such as poison control consultation fees) are your responsibility.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION OR AI OUTPUT WILL BE ACCURATE, COMPLETE, OR RELIABLE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAWCKET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING ANY INJURY, ILLNESS, OR DEATH OF A PET. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) US$100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Pawcket and its officers, directors, employees, and affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, your violation of these Terms, or your violation of any rights of another person.

15. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination (including Sections 5, 10, 12, 13, 14, and 17) will survive.

16. Changes to the Service and These Terms

We may modify the Service or these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after changes take effect means you accept the updated Terms.

17. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware and applicable federal law of the United States, without regard to conflict of law principles. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.

18. General

  • These Terms, together with our Privacy Policy, Medical Disclaimer, and any other policies referenced here, are the entire agreement between you and Pawcket regarding the Service.
  • If any provision is found unenforceable, the remaining provisions remain in effect.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
